Welcome to The Genius Vision. These Terms and Conditions ("Terms") govern your access to and use of our mobile application and the services provided therein, including but not limited to access to Panipuri making courses, live classes, recorded videos, and chat features.
By creating an account or using our App, you agree to be bound by these Terms. If you disagree with any part of these terms, you must not use our App.
1. User Accounts and Registration
1.1 To access premium content, you must register for an account by providing accurate, current, and complete information (Name, Phone Number, etc.).
1.2 You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account.
1.3 You agree to notify us immediately of any unauthorized use of your account.
2. Course Purchases and Payment Terms
2.1 Certain features and courses within the App require payment. All payments are processed securely through our authorized payment gateways: Razorpay and Cashfree.
2.2 By making a payment, you agree to the respective terms of service of Razorpay and Cashfree.
2.3 Course access is granted immediately after successful payment verification from the payment gateway. Prices for courses are subject to change without prior notice, but changes will not affect courses you have already purchased.
3. Refund Policy
3.1 Due to the digital nature of the courses, live classes, and recorded content provided through Sumit Panipuri Academy, all sales are final and strictly non-refundable once the course is unlocked and accessed by the user.
3.2 If a payment is deducted but the course is not unlocked due to a technical error, you must contact us within 24 hours with your transaction ID for resolution.
4. Intellectual Property Rights
4.1 All content available on the App, including but not limited to text, graphics, logos, images, audio clips, digital downloads, live class streams, and recorded video classes (the "Content"), is the exclusive property of Sumit Panipuri Academy or its content creators and is protected by copyright, trademark, and other intellectual property laws.
4.2 You are granted a limited, non-exclusive, non-transferable, revocable license to access the Content solely for your personal, non-commercial educational use.
4.3 Strict Prohibition: You are strictly prohibited from downloading, recording, screen-casting, reproducing, distributing, broadcasting, or selling any part of the live or recorded courses. Doing so will result in immediate account termination and potential legal action.
5. User Conduct and Live Chat Rules
5.1 You agree to use the App and its features (including live chat) in a respectful and lawful manner.
5.2 You must not post, share, or transmit any abusive, obscene, defamatory, or offensive content in the live chat or any communication channel within the app.
5.3 We reserve the right to remove any user from a live class or ban their account permanently if they are found violating these conduct rules or disrupting the learning environment.
6. Technical Requirements and Availability
6.1 You are responsible for ensuring you have a compatible device and a stable internet connection to stream live and recorded classes. We do not guarantee uninterrupted service and will not be liable for missed live classes due to internet outages on the user's end.
7. Termination
7.1 We reserve the right to suspend or terminate your account and access to the App immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms, unauthorized sharing of course content, or fraudulent payment activities.
8. Limitation of Liability
8.1 To the fullest extent permitted by applicable law, Sumit Panipuri Academy, its founders, and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or goodwill, resulting from your access to or use of or inability to access or use the App or the course content.
9. Governing Law
9.1 These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in india.
